The Office of the City Planner is responsible for the day to day work of the Brockton Planning Board. The following new applications were filed in the City Planner’s Office on behalf of the Board.

CONSERVATION COMMISSION
The Office of the City Planner is responsible for the day to day work for the Brockton Conservation Commission. Those duties include but are not limited to the following: answering the phone and dealing with questions as to wetlands jurisdiction; working with the DPW to organize clean up of water ways, and review of plans and enforcement issues as well as the following procedural work.
The following new applications were filed with the Conservation Commission during 1998.
Notice of Intent – 30: All NOI’s are reviewed for completeness. All plans are reviewed for minimum requirements. In all cases a legal notice is prepared and sent to the Enterprise, and a public hearing scheduled. Copies of all documentation are sent to the members. Copies of the notification are sent to the DPW Highway and Engineering Divisions, Board of Health, the Ward Councilor and DEP. If the project is approved an order of conditions is prepared. This document must be recorded with the registry of deeds and forwarded to the applicant and DEP. No work may begin on the project until the document is recorded. A sign must then be posted on the site with the DEP project number clearly visible.
Request for Determination – 11: All RFD’s are reviewed for completeness. All plans are reviewed for minimum requirements. In some cases abutters need notification, and in all cases a legal notice is prepared and sent to the Enterprise. Copies of all documentation are sent to the members. Copies of the notification are sent to the DPW Highway and Engineering Divisions, Board of Health, the Ward Councilor and DEP. Once the Conservation Commission has made a determination a determination of applicability is typed and forwarded to the applicant and DEP.
Certificate of Compliance – 10: Once a project is completed as built plans are sent to the members. Copies of the order of conditions as well as the approved plan must also be sent. This document is necessary to release the order of conditions which has been recorded against the property.
Amendment Requests – 2: Once an order of conditions is approved any changes are by public hearing only. All previous parties must be notified by this office of the proposed change and a legal advertisement is prepared and sent by this office to the Enterprise. Copies of the approved plan as well as the proposed plan are sent to members.
Extension Requests – 2: An order of conditions for a project is only good for three years. Prior to the expiration of the order a party may request that the Commission issue an extension. Once such a request is received the file must be checked for dates and documentation. Copies of the plan and order are sent to the members.
Enforcement Orders – 4: Once a complaint comes in from a private party or a Commission member, it must be verified if it has been made by a private party. Once verification has been made an Enforcement Order/Cease & Desist is prepared. The exact location of the property must be located on the wetland map. The police department is contacted and a police officer serves the Enforcement Order/Cease & Desist for service. The remaining members of the Conservation Commission must be notified of the violation and provided with copies of all documentation. DEP Wetlands must be notified of the violation.
PLANNING BOARD
The Office of the City Planner is responsible for the day to day work for the Brockton Planning Board. Those duties include but are not limited to the following: answering the phone and dealing with jurisdictional questions as to subdivision control, request to return to the ZBA and approval not required plans. The following is a list of all applications filed with the Planning Board and the work required under each.
Request to Return to the ZBA –2: When an application has been denied by the ZBA the applicant has the choice of waiting the prescribed period of time and reapplying to the ZBA or they can file with the Planning Board to Request to return to the ZBA. This office must notify by certified mail, return receipt requested, all abutters to the property.
Approval Not Required – 21: All ANR Plans need the signature of the Engineering Superintendent as well as the Planning Board Chair. This office is responsible for reviewing the plans to determine whether or not they fit into the criteria of an ANR. Once Engineering sets the fee, we are responsible for the mylar and plans. Once signed the mylar is returned to the applicant for recording with the registry of deeds.
Preliminary Subdivision Plans – 1: In the case of preliminary plans no legal appears in the paper, but there is a hearing before the Planning Board. Copies of plans and supporting documentation must be sent to members.
Definitive Subdivision Plans – 7: All definitive plans are approved by public hearing only. Once the plans are filed with the office a legal notice is prepared. The legal notice must appear in the Enterprise for two consecutive weeks. All abutters within 300 feet of the property must be notified by certified mail, return receipt requested. Tracking sheets are filled out for each subdivision. These sheets must be kept current to have an accurate record of where the project stands. We must make sure that all requirements are met prior to the public hearing. Once the subdivision is approved there is a 20-day appeal period. Once the appeal period has expired, the mylar plan is brought back to the Planning Board for endorsement. The plan and the method of surety are then recorded with the registry of deeds. Notification of the decision must be filed with the City Clerk.
Modification to Subdivision Plans – 5: Modifications to approved subdivisions are done by a public hearing. A legal notice must appear in the Enterprise for two consecutive weeks. All parties as well as abutters within 300 feet must be notified by certified mail, return receipt requested.
Zoning/Ordinance Changes – 12: Changes are done by way of public hearing. Once a zoning/ordinance change has been forwarded to the Planning Board by the City Council a legal notice must appear in the Enterprise for two consecutive weeks. All surrounding towns as well as OCPC and the state must be notified by certified mail, return receipt requested. After the public hearing the City Clerk’s Office must be notified of the decision.
Rescission Hearings –1: In order to rescind an approved subdivision a public hearing must be held. A legal notice must appear in the Enterprise for two consecutive weeks. All parties as well as abutters within 300 feet must be notified by certified mail, return receipt requested. If the subdivision is rescinded notification must go to the City Clerk and be recorded with the registry of deeds.
Lot Releases – With most subdivision the method of surety to the City is by covenant. The lots are not released until the road and improvements are completed. When a lot release is requested we have to make sure that all the required inspections have been done. If the roadway and improvements have not been completed the applicant can place a bond by way of cash, bankbook or a bonding company to cover the remainder of the work.
